Independent Contractor Test In California, courts and agencies generally consider an individual who is working on behalf of a company to be that company’s employee unless the company can demonstrate each of the following three requirements (A, B, and C). A. The worker is free from the control and direction of the hirer in connection with the performance B. The worker is customarily engaged in an independently established trade, occupation, or business of the same nature as the work performed for the hiring entity.
